Vacancy decontrol
Upon voluntary tenant vacancy, the landlord may charge market rent if proof is submitted to the Rent Leveling Board that the vacancy was entirely voluntary; coercive landlord actions trigger standard rent controls.
Registration
Landlords must submit income statements and rent rolls by April 15 each year to the Borough Clerk. Complexes with 20+ units require certified public accountant certification; smaller properties may use owner affidavits. Non-compliance limits increases to 3%.
Surcharges
Tax surcharges are prohibited; landlords must absorb tax increases within the 4% allowable increase.
Penalties
Maximum fine of $1,000, or imprisonment for up to 90 days, or up to 90 days of community service.
