Vacancy decontrol
Once a dwelling unit becomes vacant it is permanently decontrolled and no longer subject to the chapter, per §297-1 and §297-2D(1); DCA confirms this is Permanent Vacancy Decontrol.
Registration
Landlords must register apartments within 30 days of the effective date and provide a complete list of tenants and monthly income received from each within 60 days (§297-11A). Buildings with 3+ units must post notice of the rent-stabilization ordinance in the lobby (§297-11B).
Surcharges
Capital improvement surcharges (§297-6C): landlords may seek additional rent for major improvements after obtaining a building permit, with tenants notified at least 21 days before the hearing. Tax surcharges (§297-5A-C): based on increased property taxes divided by rentable square feet, landlords must notify tenants by August 1 each year (or within 30 days of receiving the tax bill); payments span 8 months beginning September 1.
Penalties
Violations punishable as provided in Chapter 1 General Penalty (§297-17); the Board can impose rent reductions of double or triple the amount of an illegal increase (§297-7K(4)). Failure to obtain certificates of occupancy risks fines up to $500 or imprisonment of not more than 90 days (§297-13I).
