Vacancy decontrol
Units decontrol upon vacancy and re-rental, unless the landlord used harassment to force the tenant out (in which case decontrol rights are forfeited for one year). Tenant transfers within the same complex preserve rent control if the new unit is comparable in size/condition.
Registration
Landlords must file an apartment registry form with the Department of Code Enforcement before any rent increase or hardship award.
Surcharges
Capital-improvement surcharge capped at 10% of base rent (unless the improvement is mandated by local ordinance or state law), payable over up to 36 months and excluded from CPI calculations.
Penalties
Disorderly-persons offense under Chapter 321-30; harassment used to force a vacancy causes forfeiture of decontrol rights for one year.
