- Vacancy decontrol
- Full vacancy decontrol: the rent-stabilization provisions do not apply to any dwelling unit that becomes vacant after the effective date of the vacancy-decontrol section (§231-2B).
- Registration
- Annual tenant registrations must be submitted to the Rent Leveling Board; no rent increase is permissible unless the landlord has complied with this registration requirement.
- Surcharges
- Property tax pass-through: landlord may pass 100% of a municipal property tax increase to tenants, itemized as an admissible fee over and above the 3% maximum. Senior/low-income units (occupant 65+, household income <= $50,000, no more than 2 occupants): increase capped at $25/month per the DCA survey (not independently re-confirmed against the post-2025 amended code).

Open questions
- CONFLICT: The NJ DCA 2026 Rent Control Survey states the increase cap is 'Capped at 6% plus a property tax increase fee,' tied to a CPI-based formula, but the codified ordinance section 231-23, captioned '2025 Rent Stabilization' and last amended September 2, 2025 (Ord. No. 2494-25), states the cap is a flat 3% plus a pro rata property-tax fee. The DCA survey entry may not yet reflect the 2025 amendment; the more recent 3% figure is used here per the ordinance (which wins per instructions), but this should be confirmed directly against the current codified text at ecode360.com/8638096 (compare old §231-4 to new §231-23) before publishing.
- It is unclear whether the senior/low-income $25/month alternative cap (former §231-4C) still applies after the 2025 rewrite; it is retained here from the DCA survey but unverified against the amended code.
