North Arlington rent control: maximum rent increase (2026)

Bergen County — Chapter 285, Rental Property (Rent Leveling/Control provisions). Full ordinance text ↗

Summary

Cap formula
Where the tenant supplies heat and hot water, the cap is 4%. Where the landlord supplies heat and hot water, the cap is tiered by current rent: 5% if $325 or under, 4.5% if between $325.01 and $499.99, and 4% if $500 or more. A qualified senior tenant's increase is capped at 2%, regardless of the above tiers.
Frequency
once per 12 months (at the expiration of a lease or termination of a periodic tenancy)
Notice required
30 days — Landlord must notify tenants of an allowable rent increase (annual or hardship) no later than 30 days prior to the effective date, and generally no later than 30 days before the expiration of the lease or tenancy, by certified mail or personal service with signed receipt.
Who's covered
Buildings or structures rented for housing space (per DCA, 3 or more units)
Exemptions
  • 1- and 2-family homes
  • Motels, hotels, similar premises
  • Newly constructed first-time rentals (until re-rented)
  • new construction (30 yrs from certificate of occupancy, N.J.S.A. 2A:42-84.2)
Vacancy decontrol
Upon voluntary, uncoerced vacation of an apartment, the landlord may fix the rent for the vacated apartment as deemed appropriate, but the increase cannot exceed 30% of the prior tenant's rent, and no more than one 30% increase is permitted per 12-month period. A landlord must first file a noncoercion certificate signed by the vacating tenant with the Rent Leveling Secretary within 60 days, certifying the tenant was not harassed or pressured into vacating; the Mayor and Council must approve the certificate before the increase may be enforced.
Registration
No standing annual registration system found in the retrieved text; upon a vacancy, the landlord must file a statement with the Rent Leveling Secretary certifying the apartment/building numbers, prior rent, permissible increase, vacancy duration, and new tenant's rent.
Surcharges
Capital improvement surcharges available, calculated by dividing the IRS-allowed depreciable cost by the depreciation period and prorating among benefiting tenants; capped at 15% of the tenant's rent. Hardship increases also available; both require the landlord to maintain the premises without substantial decrease in essential services.
Penalties
A violation of any provision of the article, including filing a material misstatement of fact with the Mayor and Council, is punishable as provided in the Borough's General Penalty chapter; the specific fine amount was not stated in the retrieved excerpt.
