Moonachie rent control: maximum rent increase (2026)
Bergen County — Chapter 23, Mobile Home Parks (Mobile Home Park Rent Leveling Board provisions). Full ordinance text ↗
Summary
- Cap formula
- A park operator may apply annually for a base rent increase not more than the percentage increase in the CPI over the 12-month period ending 3 months before the application; the dollar increase is calculated separately for tenant-owned and park-owned mobile homes by applying the allowed percentage to the sum of base rents in each category and dividing by the number of homes in that category.
- Frequency
- annual application
- Notice required
- 10 days — A park operator seeking an increase must notify each affected tenant at least 10 days prior to the hearing. No rent increase may be collected or fixed before issuance of a valid 'Notice to Quit' specifying the net rent increase/decrease and the date the tenant must leave if the rent is not agreed to or otherwise fixed.
- Who's covered
- Mobile home park lots/spaces (mobile homes only)
- Exemptions
- Units with fewer than 2 mobile homes on the lot
- Change of ownership of a mobile home, except by inheritance (see vacancy_decontrol)
- new construction (30 yrs from certificate of occupancy, N.J.S.A. 2A:42-84.2)
- Vacancy decontrol
- Where there is a change of ownership of a mobile home, except by inheritance, the base rent for that lot may be increased or decreased, but cannot be set higher than the highest rent charged, or lower than the lowest rent charged, on the applicable rent roll in effect at the time of the ownership change. The first annual increase for the new tenant's base rent is prorated based on the number of tenant-owned months divided by 12. Subsequent increases/decreases follow the chapter's standard provisions except for that first annual increase.
- Registration
- No standing annual tenant/unit registration requirement found in the retrieved text beyond the annual CPI-increase application process before the Ombudsman.
- Surcharges
- Capital improvement surcharges are assessed monthly over the depreciation period allowed under the Internal Revenue Code (straight-line basis). Real property tax surcharges/rebates are also available, computed per lot.
- Penalties
- For any violation of the chapter, unless otherwise specified, the General Penalty Provision (§1-5 of the Borough Code) applies; payment of a fine does not constitute compliance with the chapter.

- active
- Confidence
