Increase limit
No greater than a combination of the following: 1) any increased cost to the landlord in real estate taxes, municipal service or sewer fees; and 2) the lesser of 3.5% and the amount equal to the percentage increase in the CPI during the previous calendar year times the base rent. For these purposes, CPI defined as the cost-of-living adjustment (COLA) for social security benefits and SSI payments for the prior year as published by the Social Security Administration. Increases for hardship, capital improvement or governmentally-mandated expenses may be approved.
