Vacancy decontrol
Upon voluntary vacation, the landlord may fix the rent for the vacated apartment as deemed appropriate; landlords may not evict or remove a tenant to create a 'market rate unit', and must file vacancy statements with the Rent Leveling Board certifying the unit number, prior rent, maximum permissible increase, vacancy duration, new tenant rent, and confirming the vacation was not coerced.
Surcharges
Tax surcharge calculated by dividing the increase in property tax over the prior year by the number of rented rooms in the dwelling, payable in 12 monthly installments beginning the month after notice.
Penalties
Penalties as stated in Chapter 1, § 1-5 of the municipal code; violations affecting multiple units constitute separate offenses per unit.
