Exemptions
  • newly constructed mobile home park spaces rented for the first time (initial rent only; later increases are controlled)
  • new construction (30 yrs from certificate of occupancy, N.J.S.A. 2A:42-84.2)
Vacancy decontrol
A new tenant's initial rent may not exceed the prior tenant's rent plus up to 5%; landlord must file written notice with the Board within 10 days of new occupancy.
Surcharges
Tax and sewer-rate surcharges with 30 days' notice; utility surcharges for increased costs of trash, fuel, electric, water, and sewer service.
Penalties
Willful violation: fine up to $500 and/or up to 90 days imprisonment, per day per affected space.
