Cap formula

Maximum annual increase is 5% (2.5% for qualified senior citizen tenants), inclusive of tax increases and maintenance costs but excluding capital improvements.

Vacancy decontrol

Units becoming vacant through voluntary tenant departure, lawful eviction, or tenant death without surviving family may be decontrolled and re-let at market rates (until re-rented), provided the landlord files required certifications.

Registration

Property owners must register multiple dwellings within 30 days of adoption, including tenant names, unit designations, lease terms, rent amounts, and demised area descriptions.

Surcharges

Capital improvement surcharges allowed for IRS-classified capital expenditures resulting in material living-condition improvements, prorated over depreciation periods (filed within 12 months of completion); hardship increases available if net operating income falls below 40% of gross annual income, with management fees capped at 5% of the first $50,000 of gross income.

Penalties

Violations carry fines up to $1,000 or up to 90 days' imprisonment per offense.
