Hampton rent control: maximum rent increase (2026)

Sussex County — Chapter 66, Rent Control. Full ordinance text ↗

Summary

Cap formula
An automatic annual increase equal to the percentage difference between the CPI as of the last rent increase and the CPI as of January 1 of the year the increase is sought, not more than once per 12-month period.
Frequency
once per 12-month period from the last CPI-based increase
Notice required
30 days — Any owner seeking a CPI-based increase must notify the Rent Leveling Board and affected tenants in writing at least 30 days prior to the effective date, detailing the CPI figures used, the allowable increase, base rent before/after, and effective date; notice must be mailed by certified mail, return receipt requested (or personal service with affidavit). Failure to give proper notice voids the increase. Real estate tax surcharge notices require at least 60 days' notice.
Who's covered
Mobile home rental spaces (mobile homes only)
Exemptions
  • Mobile home rental spaces that are newly constructed and rented for the first time, or rented as a result of a tenant vacancy (until re-rented; initial rent set by the landlord, subsequent increases governed by the chapter)
  • new construction (30 yrs from certificate of occupancy, N.J.S.A. 2A:42-84.2)
Vacancy decontrol
The rent charged as a result of a tenant vacancy (including sale of a unit by a tenant) may not exceed 25% of the rent that was being charged to the previous tenant at the time of the vacancy; the newly constructed/first re-rented space is exempt from the chapter until re-rented, after which standard rules apply.
Registration
No standing annual registration requirement found in the retrieved text; applications for non-automatic increases are made on forms provided by the Township Clerk.
Surcharges
Capital improvement/major improvement surcharges available, not to exceed 10% of tenant rental income unless mandated by law, payable over the useful life of the improvement. Real estate tax surcharges available with 60 days' notice. A hardship rent increase petition process also exists.
Penalties
A willful violation of any provision of the chapter, including willful filing of a material misstatement of fact, is punishable by a fine of not more than $1,000 and imprisonment for not more than 90 days, or both; a violation affecting more than one rental space is a separate violation as to each space.

Calculate your maximum increase

This ordinance's CPI series isn't on file — confirm which index your town uses. For reference, latest 12-month CPI change — NY-NJ: 4.34% (2026-08 vs 2025-08) · Philadelphia: 4.19% (2026-08 vs 2025-08) (source: BLS).

This ordinance measures CPI over: Percentage difference between the CPI as of the last rent increase granted under this chapter and the CPI as of January 1 of the calendar year in which the increase is sought. Ordinances define their own CPI measurement window — the latest 12-month figure above may differ from the figure your ordinance requires.
