- Surcharges
- Capital improvement surcharge available for improvements that materially increase the rental value of the premises, with tenants given at least 20 days' notice detailing costs, useful life, and the monthly charge per square foot; hardship increases are capped at the same 5%/3.5% percentages plus no more than $40 monthly over the prior year, subject to Board approval after notice and hearing.

Except as otherwise provided in ยง 339-22, a landlord may increase the rental by a maximum of 5% during each twelve-month period where the landlord is required to furnish heat and by a maximum of 3 1/2% during a twelve-month period where the landlord is not required to furnish heat.
