Vacancy decontrol
Full decontrol upon lawful tenant departure: rent may be raised by the landlord without regard to rent-leveling limits; landlord must report the new rent within 15-25 days of renting the unit.
Registration
Landlord must file a complete DCA Multiple Dwelling Registration or Landlord Registration Form, plus a Tenant Lease Property Information Form, by February 1, 2022 and annually thereafter.
Surcharges
Hardship/fair-return appeal standard: net operating income of at least 40% of gross annual income after deducting reasonable operating expenses; a successful appeal can raise the total annual increase up to 20% (hearing notice posted in building lobby at least 15 business days prior). Capital improvement surcharge capped at 15% of the tenant's rent.
Penalties
Fines not to exceed $2,000 per dwelling unit.

Ordinance text

At the expiration of a lease or at the termination of the lease of a periodic tenant, no landlord may request or receive an increase greater than the percentage increase in the Consumer Price Index (CPI) or three and one-half percent (3.5%)., whichever is greater.
